1. Terms of Use
1.1. Scope
These Terms of Use govern the use of the Phlix mobile application, published by DUARD
EOOD, Company ID 203271813. By installing, opening, or using the application, the user
accepts these Terms.
Phlix is an application for participating in a light show during an event. Depending
on the event type, the user enters a sector, row, and seat, or the application uses
precise GPS location and nearby Bluetooth beacon signals to find the active event and
the user's zone. The application then connects the device to the relevant Phlix server
and displays screen colors as part of the show.
1.2. Access and functionality
- The application requires an internet connection and access to Phlix API/servers.
- Finding an active event requires foreground access to the device's precise location.
- Bluetooth events require foreground Bluetooth scanning and location permissions to determine the user's zone from configured beacons.
- The application does not require registration, a user account, in-app payment, or subscription.
- The application may temporarily change screen brightness, keep the screen active, and display dynamic colors.
- Functionality may be available only for specific events, venues, and time periods determined by the event organizer or Phlix operator.
1.3. User obligations
- Enter correct sector, row, and seat information when required by the application.
- Use the application only for its intended purpose and without attempting unauthorized access to servers, protocols, or infrastructure.
- Comply with the rules of the event, venue, organizer, and applicable laws.
- Do not use the application in a way that interferes with other users, the event, or the technical infrastructure.
1.4. Safety during light effects
Phlix may display bright, rapidly changing, or high-contrast colors. If a user has
photosensitivity, epilepsy, migraine, visual discomfort, or any other condition that
may be affected by light effects, the user should not use the application or should
stop using it immediately in case of discomfort.
The user is responsible for using their device safely and appropriately in the
surrounding environment, including without disregarding staff instructions or placing
themselves or others at risk.
1.5. Intellectual property
The Phlix name, visual elements, logo, software code, interface, images, and related
materials are owned by DUARD EOOD or used on a lawful basis. The user receives a
limited, non-exclusive, non-transferable right to use the application for personal use
in accordance with these Terms.
1.6. Availability, changes, and termination
DUARD EOOD may modify, suspend, update, or discontinue the application or individual
features when necessary for maintenance, security, event operations, platform changes,
or other technical and commercial reasons.
Access to the application may be restricted in case of abuse, breach of these Terms,
technical risk, or request by an organizer, platform, or competent authority.
1.7. Liability
The application is provided on an as-available basis. DUARD EOOD does not guarantee
uninterrupted, error-free, or universally compatible operation, especially in cases of
unstable internet connection, mobile network limitations, device settings, server
issues, or external circumstances during an event.
To the maximum extent permitted by applicable law, DUARD EOOD is not liable for
indirect damages, lost profits, loss of data, interruption of the show, or
incompatibility, except where the law expressly provides otherwise.
1.8. Third-party platforms
Downloading and using the application through Apple App Store or Google Play is also
subject to the applicable rules of Apple and Google. Apple and Google are not parties
to these Terms and are not responsible for application support.
1.9. Governing law
These Terms are governed by the laws of the Republic of Bulgaria, without prejudice to
mandatory consumer rights under applicable EU law or the law of the country in which
the application is offered.
2. Privacy Policy
2.1. Controller and scope
The controller/operator of Phlix is DUARD EOOD, Company ID 203271813. For privacy and
data inquiries, contact: info@duard.eu.
This policy applies to the Phlix application and related Phlix services, websites, and
server infrastructure. Other DUARD EOOD services may have additional or separate terms
where their functionality requires it.

Sector, row, and seat information is not intended to identify the user's name or
identity by itself. In a specific context, a venue seat may be associated with
ticketing or organizer data outside Phlix. Phlix does not require or process such
ticketing or personal data in the application.
2.3. Data not collected by Phlix
- no registration, profile, password, or username;
- no access to camera, microphone, contacts, photos, or calendar;
- no collection of nearby device names, contact lists, or Bluetooth MAC addresses for advertising or profiling;
- no advertising, behavioral analytics, marketing profiling, or sale of data;
- no in-app purchases or payment information processed by the application;
- no intentional collection of children's data or separate targeting of children.
2.4. Other DUARD services
In other DUARD services or future extensions of Phlix, personal data may be provided
by the user during registration, contests or special events, newsletter subscription,
purchases, technical support requests, third-party ID access, social features,
"tell a friend" functionality, user-generated content, or another feature that
requires such data.
If such functionality is added to Phlix, DUARD EOOD will update this policy and apply
the necessary permissions, notices, or consents under applicable law and platform
rules.
2.5. Location, Bluetooth, advertising, cookies, and tracking
Phlix does not use ad serving technology, behavioral advertising, or advertising
tracking. When the application is opened, it requests precise foreground location and
sends the current GPS coordinates to the Phlix API to find an active nearby event.
Phlix does not request background location and does not use location for advertising,
analytics, or marketing.
During a Bluetooth event, the application scans for event beacons while it is active.
It compares their configured identifiers and signal strengths with the event map on
the device to estimate a zone, then sends the resulting zone ID to the Phlix API. It
does not connect to users' personal Bluetooth accessories and does not use beacon data
for advertising or cross-app tracking. Denying location or Bluetooth permission may
prevent automatic event or zone detection.
The Phlix website may use technical cookies, local storage, or similar technologies
only when necessary for normal operation, security, or remembering settings. If
analytics, advertising, or marketing cookies are added, this policy will be updated
and consent will be requested where required.
2.6. Legal bases
Seat data, current GPS coordinates, Bluetooth beacon measurements, and the resulting
zone are processed to provide the application functionality requested by the user.
Depending on the applicable law, this processing is based on performance of the
requested service and DUARD EOOD's legitimate interest in operating Phlix. Technical
request data and logs are processed for the legitimate interests of service security,
reliability, and diagnostics. Consent is relied on where applicable law requires it.
The user controls location and Bluetooth access through the operating-system
permissions and may revoke them at any time in the device settings. Revocation does
not affect processing already lawfully performed, but location-dependent features may
stop working.
2.7. Disclosure and transfer of data
DUARD EOOD does not sell personal data and does not share data for advertising
tracking. Data may be processed by technical providers of hosting, network
infrastructure, server maintenance, or app store platforms to the extent necessary for
operation, security, and distribution of the application.
Service providers that process data on behalf of DUARD EOOD are required to protect it
in accordance with applicable agreements and data-protection law and may use it only
for the authorized service.
Data may be disclosed where required by law, judicial proceedings, competent
authorities, protection of rights, fraud prevention, corporate reorganization, or
another lawful reason. Depending on the infrastructure used, technical data may be
processed in countries outside Bulgaria subject to appropriate safeguards under
applicable law.
2.8. Retention, deletion, and correctness
Locally stored sector, row, seat, and language remain on the device until the user
changes them, clears application data, or uninstalls the application. The downloaded
Bluetooth event map and live beacon measurements are used during the active app session
and are not intended to create a movement history. GPS coordinates and zone requests
are used to immediately provide the functionality. Standard server logs may contain
request details and are retained only for a reasonable period for operation, security,
and diagnostics, unless a longer period is required or permitted by law.
DUARD EOOD makes reasonable efforts to keep data in its possession current and correct
where this is applicable to the specific service.
2.9. Security
DUARD EOOD applies reasonable technical and organizational measures to protect data,
including limiting access to server infrastructure and using network measures
appropriate to the technical environment. No system can be guaranteed to be absolutely
secure.
Requests containing GPS coordinates or zone IDs are sent to the Phlix API over HTTPS.
Real-time show color messages may use UDP and contain show-control identifiers and
colors, not an account, name, contact details, or payment information.
2.10. User rights
Where applicable law provides, the user may request access, correction, deletion,
restriction, objection, or data portability. Due to the absence of accounts and
personal identifiers, the user may need to provide additional information so that a
specific technical request can be located, if such request is available at all.
Users may also revoke location or Bluetooth permission in the device settings, clear
locally stored application data, or uninstall Phlix. Requests concerning data or
deletion may be sent to info@duard.eu. Users may
lodge a complaint with the Bulgarian Commission for Personal Data Protection or their
competent local supervisory authority.
2.11. Children
Phlix is not intended to collect personal data from children. If a parent or guardian
believes that personal information has been provided through the application, they may
contact DUARD EOOD at info@duard.eu for review and
deletion where applicable.
2.12. Changes
DUARD EOOD may update these Terms and this Privacy Policy due to changes in the
application, infrastructure, legal requirements, or platform rules. Continued use of
the service after an update is published means acceptance of the new version to the
extent permitted by applicable law.
